£85,000 settlement for injured motorcyclist
The claimant was involved in a motorcycle collision in August 2005, and Access Legal from Shoosmiths was appointed to act for him on a no-win-no-fee basis. We represented him through his case to conclusion, including instructing a barrister to advise the claimant in conference. The case was settled out of court after proceedings had been issued and served.
The collision took place when the claimant was stationary at a roundabout, and the defendant hit his motorcycle in the rear. The impact caused the claimant to be catapulted into the air, landing heavily on his right leg. He sustained a serious injury to his right knee and lower back.
We obtained extensive medical evidence from an orthopaedic surgeon. The claimant suffered a fracture of the upper tibial plateau and had a number of operations to his leg and knee. He also sustained an injury to his lower back, and had spinal surgery. As a result of his injuries, he was prevented from returning to work as a motorcycle instructor and has subsequently set up his own motorcycle shop.
Medical evidence supported the fact that the claimant could not continue working as an instructor. However, he had only been working as an instructor for around six weeks before the accident. We were able to produce evidence to prove that he would have continued working as an instructor following the accident, and brought a significant claim for loss of income even in the absence of a long track record of working as an instructor.
