We visited our client at home shortly after his discharge from hospital, and immediately arranged for rehabilitation assistance from a care manager. Throughout the claim we secured several interim payments to assist our client financially whilst he was signed off work.
Prior to the accident our client was employed as machine/plant operator/labourer. He was not able to return to this occupation, and with the assistance of his case manager, arrangements were made for him to undertake retraining, following which he returned to work as a fibreglass fabricator.
In progressing the claim, we obtained evidence from a consultant orthopaedic surgeon, psychiatrist and an occupational therapist.
The claim was settled approximately two-and-a-half years after the accident, at a settlement meeting. Our client's wife also suffered from a psychiatric injury after she witnessed the accident, and we pursued a successful claim for compensation on her behalf.
Background
Our client was on his way home from work travelling along a B road, when the defendant, who was travelling in the opposite direction, encroached onto his side of the road and into a head-on collision with his vehicle.
The other driver pleaded guilty to a charge of driving without due care and attention, following which her insurers admitted liability.
Our client suffered multiple orthopaedic injuries, including a fracture to his right femoral shaft, left knee and navicular bone.
