What did we do?
Access Legal from Shoosmiths brought a claim against the tour operator under The Package Travel, Package Holiday and Package Tour Regulations 1992. The claim was brought in this country and was successful.
Background
Mrs P went on a package holiday to Turkey. Midway through it she went on an arranged trip provided by a local coach operator to one of the region's beauty spots, which included a river. One of the local operator's staff was encouraging people to swim in the river, but Mrs P did not want to. However, she was pulled into the river by her arm, against her wishes, by one of the staff and hurt her arm. It was later discovered that Mrs P had suffered a broken arm. Mrs P received £7,500 compensation for her injury.
