Background
Mr Thomas was 27 and working as a delivery driver when he sustained a seemingly minor injury to his back when moving a pallet from his trailer. A soft tissue injury was diagnosed, and subsequent investigations including scans and X-rays revealed no structural damage or abnormality of his spine.
However, Mr Thomas continued to suffer from debilitating pain and was unable to return to work. Access Legal from Shoosmiths instructed several medical experts during the course of the claim, and Mr Thomas was eventually diagnosed as having chronic regional pain syndrome. Although this diagnosis was disputed by our opponents, settlement was negotiated a few weeks before trial in the sum of £350,000.
