The Defendant, who had been our client's employer, contested liability right up to the last minute but Access Legal from Shoosmiths persevered and an admission of liability was eventually forthcoming. An out of Court settlement of almost £20,000 was then agreed between the parties.
Our client had worked on a production line for about a year and developed a rotator cuff tear as a result of repetitive strain from the work she performed. This left her with continuing pain and weakness in her right arm, which impeded her from carrying out normal everyday activities.
Access Legal from Shoosmiths was able to obtain medical evidence which linked the injury to the demands of her job, however, her employer continued to deny liability.
A date was set for trial, but at the last minute the Defendant admitted liability and made a modest offer of settlement. With our client's agreement, the offer was rejected and a round of negotiations ensued after which Access Legal from Shoosmiths were able to agree a more favourable settlement figure, which our client accepted.
Case handler
The case was handled by Barbara Woodbridge, an associate in the personal injury department at Access Legal from Shoosmiths' Northampton office. Barbara is a solicitor specialising in complex neurological injuries, including catastrophic head and spinal injuries. She is a Member of the Law Society's Personal Injury Panel, and the Association of Personal Injury Lawyers.
