What did we do?
Mr H was injured during the course of his employment on 15 December 2006, and Access Legal from SHoosmiths took the case on a on a no-win-no-fee agreement, taking it through to an amicable financial settlement.
Background
Mr H was in the process of delivering a three-seater sofa to a customer in Basingstoke when it was discovered that the sofa would not fit through the customer's front door. Mr H, assisted by a colleague, had to carry the sofa around to the rear of the customer's property, navigating a narrow alleyway and over a distance of approximately 600 yards.
As a result, Mr H sustained a sprain to his lower back. On the medical evidence, the injury also aggravated and worsened Mr H's pre-existing degenerative disease in his lower back by a period of three to four years. Mr H was told that the symptoms he was experiencing following his accident would be permanent.
Mr H was absent from work for six months and, although he was able to carry out everyday tasks, he was unable to continue delivering furniture as he was not capable of undertaking manual and strenuous physical jobs.
Mr H's employer argued that he should be partly to blame for the accident on the basis that he should have asked for additional assistance in carrying the sofa if he considered it to be too heavy. While Mr H accepted this argument, settlement negotiations were very successful, and he received a settlement above and beyond his expectations.
