We instructed an eminent gastro-enterological expert, who specialises in dealing with the need for, and subsequent effects of, gastric surgery.
Background
Our client sustained painful whiplash injuries in a road traffic accident shortly before departing for a six month sabbatical abroad. Her injuries restricted her ability to exercise, and during her time abroad she did not have ready access to medical treatment. This resulted in significant weight gain, and an exacerbation of a pre-existing but controlled gastric condition, which ultimately necessitated weight loss surgery.
Our client underwent a significant operative procedure in a private clinic. The surgery was successful in enabling her to control her weight, and in resolving her gastro-oesophageal symptoms, but side effects of the surgery meant she was no longer able to work full-time in her pre-accident occupation.
The claim was settled by negotiation with the defendant's representative, two weeks before the final trial.
