Increased compensation for client injured in RTA

We acted for Mr Graham Brunt in a claim for personal injury compensation following a road traffic accident. The other party disputed the amount which should be paid to our client, and the case was heard before a judge at Guildford County Court
What we did
After receiving instructions to act on behalf of Mr Brunt we quickly secured an admission of liability from the other party's insurance company and also arranged for Mr Daniels to have some physiotherapy treatment, the cost of which was included in the claim.
Within five months of being instructed we had already obtained a medical report from an independent expert, forwarded this on to Mr Brunt for approval, and then disclosed the report to the other party's insurers inviting an offer to settle.
However, Mr Brunt did not make a recovery from the injury sustained within the original period of time estimated by the medical expert, and so an updated medical report was obtained.
Following disclosure of the updated report, negotiations began to try and settle the claim, but the other party's insurers refused to increase their offer of £3,000 in respect of the personal injury compensation. We felt that the claim was worth significantly more, so court proceedings were issued.
We handled the case efficiently throughout the court process and kept Mr Brunt informed of progress. We also continued to try and negotiate with the other party, but to no avail. The case was therefore taken to a final court hearing, and the award of damages made by the Judge was £4,000, significantly more than the insurers had offered.
In addition to the compensation for his injuries, we also recovered compensation for Mr Brunt's lost earnings (following time off of work due to his injuries), and other financial losses. The court also awarded more than £125.00 interest on the compensation amount.
The case has now been submitted for reporting on Lawtel, and can be used in future as a precedent case for any accidents involving similar injuries.
