Prenuptial agreements
Comfort can be taken from having an agreement in place before marriage, which sets out how assets will be divided in the event of the marriage breaking down.
A prenuptial agreement may also provide for whether and how much maintenance will be payable by one former spouse to the other for them and/or for any children.
Whilst not binding, courts are paying increased attention to prenuptial agreements, but it's important they're prepared in a way that's likely to be upheld by the court.
There are also equivalents of prenuptial agreements for cohabitants. Again, whilst not legally binding, they may have weight in the event that assets are divided.
