Consumer rights

Consumer rights are there to protect consumers when the item or service you've bought doesn't meet expectations.

What are your consumer rights?

Unfortunately, resolving issues with shops, sellers or suppliers isn't always as friendly or straightforward as you might have hoped.

Why use Access Legal from Shoosmiths?

We have an experienced team that can advise you on your consumer rights, the seller's contractual obligations, and the extent to which there has been a breach. We can determine whether you're entitled to have your goods repaired or replaced, or compensation paid for other losses you've incurred.

Our team has extensive experience pursuing court proceedings on behalf of consumers and upholding consumer rights, but will always discuss alternative ways of resolving your dispute and achieving the result you're after. We'll gather evidence to support your claim and negotiate with the other party on your behalf.

Our aim is to put you back in the position you'd have been in had you been provided with satisfactory goods and services you thought you were purchasing in the first place, along with recovering compensation for any additional losses you've suffered along the way.

Important things to consider

Be clear about the terms of a transaction.  If there's a written contract, be sure to read it carefully and ask the salesperson or trader to clarify anything that isn't clear.  Always keep such documents.

Should an issue arise with goods or services you've bought, the first thing to do is raise a complaint directly with the seller and work out whether the problem can be resolved amicably.

Do so in an open and friendly way.  If the goods are covered under a warranty they might be replaced or repaired for free.  Many companies have a policy on returning and exchanging goods or will offer some extra customer service to compensate any problems you encounter.
