How much compensation to expect
The aim of the compensation is to put you back in the same position you'd have been in - as far as money is able - had the negligence not happened.
The value of a claim consists of two elements:
- general damages - this is monetary compensation for your pain, suffering and loss of amenity. For example, if the negligence has caused you to lose a limb, then there will be a some of money awarded to you to reflect the pain and suffering that you will have inevitably gone through as a result of that trauma
- special damages - these are the financial losses or 'out of pocket expenses' that you have incurred or will incur as a direct result of the negligence, for example loss of earnings, medical costs, care costs etc. These are awarded in addition to general damages.
