What if they do not admit it?
The answer's simple. The other party doesn't have to admit they were in the wrong - admit liability - in order for you to recover compensation from them.
They may settle your claim without ever admitting they were in the wrong. In some cases, they may even deny liability but still make a financial offer.
There are a number of reasons why the other side may agree to pay you compensation but not admit they have actually done anything negligent. It can be to protect the reputation of the Trust or individual concerned. It could be to protect themselves against other claims for similar injuries sustained whilst in their care.
Of course, if the other side will not admit that they were in the wrong, or if they deny liability, it may mean you will not be successful in your action against them. We will advise you if at any point it becomes clear to us that you are unlikely to win your claim.
However, the lack of an admission of liability does not automatically preclude you from pursuing the case.
So when you ask: 'What if they don't admit it?', we can confidently say it may not matter.
