If a professional you've hired has been negligent and you suffered a loss, the law can put you in the position you would have been in had you not received and acted upon their advice.

You expect professional advisers to provide you with reasonable and competent advice. If things go wrong and they are negligent causing you a financial or other material loss, you may wish to seek recovery of those losses from the adviser or his/her insurers.

In the first instance, you may wish to seek redress directly rather than pursue legal action. Most professions will have established complaints procedures and codes of conduct set by governing bodies to whom you can complain.

However - a word of caution. You should be careful that making a complaint to a professional governing body (such as the Legal Ombudsman if you are complaining about a solicitor) does not later prevent you from pursuing court action, as you may be prevented from recovering some or all of your losses.

If in doubt, seek legal advice before deciding what steps to take, as your complaint about your solicitor may not address the full extent of the negligence or all of the losses suffered.

The aim of the law in cases of professional negligence is to put you in the position you would have been in had the negligence not occurred. For example, the loss of value in a property as a result of negligent advice from a surveyor, or money spent because you relied on negligent advice. You can claim for a refund of any fees paid, but the focus in a professional negligence claim is on recovering losses caused by the negligence.
